아시아 인권위, 이석기 의원 무죄 긴급 청원
-반란음모 무죄 선고는 박 정부의 반란음모 조작 입증

아시아 인권위원회는 이석기 의원 대법원 판결을 앞두고 21일 이 의원에 대한 무죄선고를 긴급 청원하고 내란선동죄의 적용 중지를 요구하며, “의사와 표현의 자유에 대한 권리의 증진과 보호를 위한 유엔 특별보고관에게 별도의 편지를 보내 이 사건에 그가 개입할 것을 요청”할 것이라고 전했다.

아시아 인권위는 이 의원이 지난해 고등법원에서 내란음모에 대해 무죄를 받은 점에 대해, 이는 “국정원이 정치적 목적을 위해 사용하려는 의도로 ‘반란음모’ 사건을 조작했다는 주장이 옳다”는 것을 입증해준다고 말했다.

이어서 그럼에도 이 의원이 내란을 선동한 혐의에 대해 9년 징역형이라는 중형을 선고 받은 사실을 언급하고 법원이 “그 위험이 현존하는지 아닌지 입증하지도 않고 오로지 그들이 언급한 것에 근거”하여 유죄판결을 내린 것에 대해 심한 우려를 나타냈다. 인권위는 그런 논리라면 “‘정부를 비판하는 사람은 누구나 내란선동이라는 끔찍한 혐의를 받을 수 있다'”고 말하며 대법원이 내란선동에 대해 다시 유죄판결을 내린다면, 한국에서의 표현의 자유는 “훨씬 더 심각한 제약”을 받을 것이라고 말했다.

아시아 인권위는 국가보안법 하나만으로도 한국에서의 “표현의 자유가 심각하게 훼손”된 상황에서 형법상 내란선동죄가 다시 한번 표현의 자유를 가질 권리를 제한할 수 있다는 가능성을 보고 충격과 실망을 금치 못하며, 최근 “한국은 시민적, 정치적 권리에서 심각한 퇴보”를 보여왔으며 한국에서 “시민들의 피와 땀” 그리고 “한국과 아시아 및 국제 인권단체들의 연대 노력”으로 “힘들게 얻은 인권의 아주 소중한 성취가 무시”되는 상황에 대해 우려를 표명했다.

아시아 인권위는 “대법원의 결정으로 인해 한국에서 표현의 자유를 억압하기 위한 무기로서 정부가 내란 선동죄를 추가하도록 허용되어서는 안 된다는 것을 강조”하며 국제사회에 이석기 의원의 무죄석방을 청원하는 편지를 박근혜 대통령에게 보내달라는 당부와 함께 성명서를 마무리 짖는다.

The Asian Human Rights Commission has received information that in South Korea, there are deep concerns over the so-called ‘insurrection conspiracy charges against National Assembly Member and incumbent lawmaker Lee Seok-ki’ and several others in South Korea, by the Seoul High Court ? for which he and several others have been sentenced to 9 years imprisonment based on a recorded remarks he made to his political followers.

아시아 인권위원회는 이 의원이 자신의 정치적 추종자들 앞에서 행한 연설의 녹취록을 근거로 이 의원과 다른 몇 명이 한국 고등법원에서 9년의 징역형을 선고받도록 한 소위 ‘국회의원 이석기와 다른 몇 명에 대한 반란음모 혐의’에 대해 한국사회에 깊은 우려가 있다는 정보를 받았다.

CASE NARRATIVE:

사건 개요

The Park Geun-hye administration has arrested seven members of the Unified Progressive Party (UPP) including the incumbent member from the National Assembly, Lee Seok-ki in 2013. They have been accused of violating National Security Laws, conspiring insurrection and inciting insurrection through the May 12 Foundation meeting in the same year. However, in August 2014, the Appeal Court acquitted the charge of insurrection conspiracy giving reasons that the existence of ‘RO’ which was alleged to execute the insurrection conspiracy could not be accepted and that no specific act of implementing the insurrection conspiracy took place. The decision made in the Court of Appeal, which is the final court of fact-finding proceedings in the Korean judicial system, can be interpreted that the trial court recognized that the insurrection conspiracy charge was fabricated by the Park Geun-hye administration.

2013년 박근혜 정부는 현직 국회의원 이석기를 포함 통합진보당 당원 7명을 구속했다. 이들은 같은 해 5월 12일 창립 회의에서 반란을 음모하고 선동함으로써 국가보안법을 위반했다는 혐의를 받았다. 하지만 2014년 8월 고등법원은 반란음모를 실행하기 위한 조직이라고 주장됐던 ‘RO’의 실체가 입증되지 않았고 반란음모의 구체적 행위도 없었음을 근거로 반란음모애 대해 무죄를 선언했다. 한국 사법제도에서 사실확인 심리의 최종법원인 고등법원에서 내린 이 판결은, 반란음모 혐의가 박근혜 정부에서 조작한 것임을 재판부가 인정한 것으로 해석될 수 있다.

This proves the claim that the National Intelligence Service fabricated the ‘insurrection conspiracy’ case with a view to use it for political purpose though there was no insurrection conspiracy at all.

이 사실은 반란음모가 전혀 존재하지 않았지만 국정원이 정치적 목적을 위해 사용하려는 의도로 ‘반란음모’ 사건을 조작했다는 주장이 옳다는 것을 입증해준다.

According to the information received by the AHRC there is also deeply concern over the verdict handed down by the judges in the Court of Appeal. The Court found all 7 defendants in violation of Article 7 of the National Security Law. Furthermore, despite finding no evidence of any insurrection conspiracy, the court accepted charges of the incitement of an insurrection and sentenced heavy penalties to the defendants including nine years imprisonment to Rep. Lee Seok-ki.

아시아 인권위원회가 받은 정보에 따르면 고등법원 판결에 대해서도 깊은 우려가 있다. 고등법원은 피고인 7명 전원에게 국가보안법 제 7조 위반 판결을 내렸다. 더욱이 내란음모에 대한 아무런 증거도 찾지 못했음에도 불구하고 항소법원은 내란선동 혐의들을 인정했고 이석기 의원의 9년 형을 포함하여 피고인 전원에게 중형을 선고했다.

The National Security Law has been long criticized by the international community including human rights NGOs as an unjust law and called for its abolishment of or amendment. Amid concerns over the abuse of the National Security Law as completely denying the freedom of expression, the Court accepted charges of violating Article 7 of the National Security Law, as it has done in past precedents. This is an extremely grave situation.

국가보안법은 부당한 법으로 인권 비정부기관들을 포함한 국제사회에서 오랫동안 비난을 받아왔고 법 폐기 혹은 개정 요구를 받아왔다. 표현의 자유를 완전히 부정하는 국가보안법 남용에 대한 우려가 있는 가운데 과거 사례에도 그러했듯이 고등법원은 국가보안법 7조 위반 혐의들을 인정했다. 이것은 매우 심각한 상황이다.

What is even more concerning is that the ‘insurrection incitement’ charges were accepted in the Court. The crime of insurrection incitement is “another National Security Law’ within Korea’s Criminal Act. With regards to insurrection incitement, the court deemed that the accused can be found guilty solely based on what they have said without having to verify whether the risk is present or not. In other terms, ‘anyone who criticizes the government might face the horrific charge of insurrection incitement’. If the Supreme Court finds the accused guilty of insurrection incitement as it stands, the freedom of expression in Korea will be restricted even more severely based not only on the existing National Security Law but also on the unjust provision of the crime of insurrection incitement.

훨씬 더 염려스러운 것은 ‘내란선동’ 혐의들이 법원에서 인정됐다는 것이다. 내란선동죄는 한국 형법에 있는 ‘또 다른 국가보안법’이다. 내란선동에 대해서 법원은 그 위험이 현존하는지 아닌지 입증하지도 않고 오로지 그들이 언급한 것에 근거하여 피고인들이 유죄판결을 받을 수 있다고 간주했다. 달리 말하면, ‘정부를 비판하는 사람은 누구나 내란선동이라는 끔찍한 혐의를 받을 수 있다’. 만일 그러한 입장에서 대법원이 피고인들에게 내란선동에 대해 유죄판결을 한다면, 한국에서의 표현의 자유는 현 국가보안법뿐만 아니라 내란선동죄에 대한 부당한 조항에 근거하여 훨씬 더 심각한 제약을 받을 것이다.

Under the National Security Law alone, freedom of expression in Korea has been gravely undermined, far from being fully guaranteed. The Asian Human Rights Commission expressed its shock and disappointment to see the possibility that the crime of insurrection incitement in the Criminal Act might restrict the right to freedom of expression once again while the National Security Law, which is the biggest obstacle of human rights development, remains to cause numerous other human rights violations.

국가보안법 하나만으로도 한국에서의 표현의 자유는 온전히 보장되기는 커녕 심각하게 훼손됐다. 아시아 인권 위원회는 인권 향상에 가장 큰 장애물인 국가보안법이 수많은 다른 인권 침해사태를 야기시키는 와중에 형법상 내란선동죄가 다시 한번 표현의 자유 권리를 제한할 수 있다는 가능성을 보고 충격과 실망감을 표현했다.

Recently, Korea has seen grave retrogrades in civil and political rights. Invaluable achievements in human rights hard earned through blood and sweat of Korean citizens and solidarity efforts by local, region-based and international human rights groups are being dismissed and dismissed too easily.

최근 들어, 한국은 시민적, 정치적 권리에서 심각한 퇴보를 보여왔다. 한국 시민들의 피와 땀으로, 그리고 한국과 아시아 및 국제 인권단체들의 연대 노력들을 통해 힘들게 얻은 인권의 아주 소중한 성취가 무시되고 있으며 너무 쉽게 묵살되고 있다.

The Asian Human Rights Commission would like to emphasize that the Supreme Court’s decision in this case should not become a trigger that allows the government to add the crime of insurrection incitement as a weapon in suppressing the freedom of expression in Korea.

아시아 인권위원회는 이 사건에 대한 대법원의 결정으로 인해 한국에서 표현의 자유를 억압하기 위한 무기로서 정부가 내란 선동죄를 추가하도록 허용되어서는 안 된다는 것을 강조하고 싶다.

Therefore please write to the President of South Korea, Her Excellency Park Geun-hye to take appropriate action to release lawmaker Lee Seok-ki, and safeguard freedom of expression of all citizens in South Korea.

그러므로 한국의 박근혜 대통령께 이석기 의원을 석방시키고 한국의 모든 국민들의 표현의 자유를 보호하기 위하여 적절한 행동을 하도록 글을 써 주었으면 한다.

The AHRC will write a separate letter to the UN Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression calling for his intervention into this matter.

아시아인권위는 의사와 표현의 자유에 대한 권리의 증진과 보호를 위한 유엔 특별보고관에게 별도의 편지를 보내 이 사건에 그가 개입할 것을 요청할 것이다.

I note with concern the conviction of, Lee Seok-ki, a Member of the National Assembly, by the Seoul High Court on a charge of insurrection conspiracy based on recorded remarks he made to his political followers and for which he has been sentenced to nine years in prison.

저는 서울고법이 대한민국 국회의원 이석기씨에게 그가 그의 정치적 추종자들에게 했던 녹취를 근거로 유죄판결을 내리고 9년 징역형을 선고한 것에 대해 우려하며 편지를 쓰고 있습니다.

I will not comment on the merits of the facts presented in this case, which is currently on appeal before Korea’s Supreme Court or interfere in any other way in the internal affairs of the Republic of Korea. I note, however, that Mr. Lee’s conviction is taking place under the provisions of a highly restrictive National Security Law, established during the pre-1987 era of autocratic military rule that appears to contradict both the Republic of Korea’s international human rights treaty obligations and the nation’s global reputation as a highly successful prosperous democracy.

저는 현재 한국의 대법원에서 상고중인 이 재판에서 제시된 사실들의 시비에 대해 언급하거나 또는 다른 어떤 방법으로 한국의 내정을 간섭하지 않을 것입니다. 그러나 저는 이 씨가 독재 군사 통치 시대인 1987년 이전에 제정된 상당히 제한적인 국가보안법의 항목들의 위반으로 유죄판결을 받았으며, 이는 한국의 국제 인권 조약 의무와 상당히 성공하고 번성한 한국의 국제적인 명성에 모순되는 것처럼 보이는 것에 주목합니다.
